CBI’s Special Court has asked the trial court to consider Chidambaram’s interim bail request.

The apex court said if Chidambaram’s request for interim bail is not considered by the trial court on Monday itself, his CBI custody would be extended by three more days.

A bench of justices R Banumathi and A S Bopanna directed CBI to file its response on Chidambaram’s plea challenging the non-bailable warrant issued against him and the subsequent orders of the trial court remanding him to CBI custody in the case.

Hours after the Supreme Court on Monday asked the trial court to consider former finance minister P Chidambaram’s request for interim bail in the INX Media corruption case, Solicitor General Tushar Mehta sought modification of the order.

The bench of the CJI rose, while Chidambaram’s plea was not mentioned as planned, PTI reported. Chidambaram’s lawyers assembled in the courtroom of Chief Justice of India Ranjan Gogoi where Ayodhya case was being heard. They were likely to mention his plea again and it happened. 

Counsel for the Congress leader said they are waiting for Registrar’s message on listing the petition, PTI reported. Chidambaram’s lawyers tried to list the matter in court today itself, PTI stated. But Chidambaram’s lawyers had deliberations in the consultation room in the top court, according to PTI. 

Considered his request, the apex court advanced the hearing in the case to Tuesday from Thursday.

In the post-lunch session, Mehta appeared before a bench of justices R Banumathi and A S Bopanna and said the order passed earlier in the day would cause jurisdictional difficulty in its implementation.

Earlier today, the Supreme Court listed Chidambaram’s bail plea, seeking protection from arrest, for Friday. Meanwhile, Enforcement Directorate (ED) and the CBI issued a look out notice against Chidambaram and both investigative agencies, earlier in the day, filed a caveat against the former finance minister in the top court. “Chidambaram’s need to be dealt with ‘iron hand’, the Aircel-Maxis probe is still going on.” CBI and ED tell the court, news agency PTI reported.

Chidambaram’s plea in the apex court now becomes pointless as he was looking for protection from arrest. Chidambaram will now have to seek bail before the Rouse Avenue court where the INX Media case was being heard.
